These Terms of Use and Purchase ("Terms") govern your access to and use of the website located at https://www.talentstech.com (the "Website") and your purchase and use of the digital content, reports, assessments, biometric-based personality analysis, consultations, workshops, software, subscriptions, coaching programs, certifications and other related services offered through it (collectively, the "Products").

The Website and the Products are owned and operated by Talents Tech Executive Sdn. Bhd. (1203068-V), a company incorporated in Malaysia with its registered address at 83-1, Jalan BK 5A/2, Bandar Kinrara, 47180 Puchong, Selangor, Malaysia, together with its affiliates, branch offices, authorised partners, contractors, technology providers and representatives (collectively, "TalentsTech", "we", "us" or "our").

By accessing the Website, registering an account, participating in any assessment, submitting biometric information, attending consultations, purchasing any Product, or using any part of the Website, you confirm that you have read, understood and agree to be legally bound by these Terms in full.

If you do not agree with any part of these Terms, you must immediately discontinue use of the Website and Products.

These Terms incorporate by reference:

• Privacy Policy;

• Refund and Cancellation Policy;

• product-specific terms;

• consultation terms;

• workshop and certification terms;

• corporate or institutional agreements;

• biometric-consent forms; and

• all policies published on the Website.
   

1.6

Centralised processing. All TalentsTech software, systems, databases, biometric infrastructure, operational systems, cloud environments, analytics systems and digital platforms are owned, controlled or operated by Talents Tech Executive Sdn. Bhd. (1203068-V) in Malaysia.

Users outside Malaysia access the Website and Products remotely. By using the Website, you expressly consent to cross-border transmission, processing, storage, hosting and handling of your information in Malaysia and any other operational jurisdictions selected by TalentsTech.

1.7

The official and legally binding version of these Terms is the English version. Any translated version is provided solely for convenience and shall not have legal effect.

2. Eligibility and Intended Use

2.1 Age.

You must be at least eighteen (18) years of age, or the higher age of majority or legal contractual age applicable in your jurisdiction, to access the Website or purchase any Product.

If you are below the required legal age in your jurisdiction, you may only access the Website or purchase any Product with the consent, agreement and authorisation of your parent or legal guardian.

By using the Website, you represent and warrant that:

• you satisfy the applicable legal-age requirement; or

• you have obtained valid consent and authorisation from your parent or legal guardian.
   

2.2 Parent or guardian liability.

Where a parent or legal guardian authorises, permits, purchases, registers for, or facilitates access to the Website or any Product for a minor, that parent or legal guardian:

(a) represents and warrants that they possess full legal authority to provide such consent;

(b) accepts full responsibility for the minor's conduct and use of the Website and Products;

TalentsTech makes no representation, warranty or guarantee regarding:

• medical outcomes;

• mental-health outcomes;

• behavioural outcomes;

• educational outcomes;

• employability;

• relationship outcomes;

• scientific validity;

• psychological accuracy;

• clinical recognition; or

• predictive reliability.
   

2.5 No professional reliance.

No Product should be relied upon as:

• medical advice;

• psychiatric advice;

• psychological diagnosis;

• recruitment screening;

• legal advice;

• financial advice; or

• professional certification.

Users should seek qualified professional advice where appropriate.
 

2.6 B2B and institutional use.

Where Products are provided through an organisation, institution, employer, school or corporate client under a separate written agreement ("B2B Agreement"), that agreement governs institutional usage.

Individual users may not independently use the Products for:

• hiring;

• employee screening;

• lending decisions;

• educational placement;

• insurance evaluation;

• surveillance; or

• automated profiling.
   

2.7 Translation disclaimer.

Translated versions of Reports, Products or Website content may contain inaccuracies or interpretive differences. The English version prevails in all circumstances.
 

3. Account Registration

3.1

Access to certain Products requires account registration.
 

3.2

You agree to provide accurate, current and complete information.
 

3.3

You are solely responsible for safeguarding your credentials and all activities conducted under your account.
 

3.4

TalentsTech may suspend, restrict or terminate any account where:

• these Terms are breached;

• fraudulent activity is suspected;

• abusive conduct occurs;

• operational risk exists; or

• required by law.
   

3.5

You may not maintain multiple accounts without written approval.
 

4. Biometric Data, Reports and Assessment Systems

4.1 Collection of biometric data.

Certain Products require biometric fingerprint capture involving all ten (10) fingerprints ("Biometric Data").

4.2 Explicit consent.

By proceeding with biometric capture, you provide express, informed and specific consent to TalentsTech for:

• biometric collection;

• processing;

• analysis;

• report generation;

• consultation support;

• system operations; and

• related services.
   

4.3 Sensitive-data acknowledgement.

Biometric Data constitutes sensitive personal data under applicable privacy and data-protection laws.
 

4.4 Biometric purge procedure.

TalentsTech may permanently purge biometric records, templates and derived identifiers after report generation.

Once deleted, Biometric Data cannot be recovered, regenerated or reproduced.
 

4.5 No biometric identification function.

TalentsTech does not operate:

• a government identification system;

• forensic identification system;

• surveillance platform;

• criminal-identification system;

• identity-authentication platform; or

• immigration-verification system.

Fingerprint data is not used to legally verify identity.
 

4.6 Nature of Reports.

Reports are proprietary informational and self-reflection tools only.

Reports:

• are not scientific certifications;

• are not psychological diagnoses;

• are not employment evaluations;

• are not predictive guarantees; and

• are not objective measurements of intelligence, capability or future performance.
   

4.7 No scientific or clinical validity guarantee.

TalentsTech does not warrant that any Product possesses:

• clinical validation;

• psychiatric recognition;

• scientific consensus;

• governmental certification; or

• medical endorsement.
   

4.8 Assumption of risk.

You voluntarily assume all risks arising from your interpretation or use of:

• Reports;

• Premium Reports;

• consultations;

• workshops;

• coaching sessions;

• assessment outputs; or

• personality classifications.
   

4.9 Waiver and release.

To the maximum extent permitted by law, you irrevocably waive and release TalentsTech from all claims arising from:

• disagreement with assessment outcomes;

• emotional reactions;

• psychological interpretations;

• behavioural interpretations;

• third-party misuse of Reports;

• inability to reproduce deleted biometric records;

• system discontinuation; or

• platform interruption.
   

4.10 Research and analytics.

TalentsTech may utilise de-identified and aggregated assessment information for:

• analytics;

• research;

• system improvement;

• benchmarking; and

• operational enhancement.
   

4.11 Twelve-month online availability.

Reports may remain accessible online for up to twelve (12) months from the original generation date.
 

4.12 No ongoing-access guarantee.

TalentsTech does not guarantee:

• permanent online access;

• perpetual downloads;

• future compatibility;

• ongoing platform support; or

• indefinite storage.
   

4.13 User responsibility for backups.

Once any Report or downloadable Product has been delivered or downloaded, you assume sole responsibility for:

• retaining backup copies;

• file security;

• preventing unauthorised disclosure;

• software compatibility; and

• data retention.
   

4.14 International processing acknowledgement.

You expressly acknowledge that:

• data may be processed internationally;

• cloud providers may operate outside your jurisdiction;

• privacy protections may differ between jurisdictions; and

• cross-border processing is necessary for service delivery.
   

4.15 Operational discretion.

TalentsTech reserves absolute discretion to:

• modify methodologies;

• discontinue frameworks;

• alter scoring systems;

• update personality models;

• replace technologies;

• migrate infrastructure; and

• discontinue Product features.
   

Such changes do not entitle users to refunds or compensation.
 

4.16 Artificial intelligence and third-party analysis disclaimer.

You acknowledge and agree that any upload, submission, sharing, transfer or use of Reports, Premium Reports, biometric-related outputs, consultations, assessment results or other Product information with any artificial intelligence system, third-party platform, external software, chatbot, language model, analytics engine or automated interpretation system is done entirely at your own discretion and risk.
 

TalentsTech shall not be responsible or liable for any:

(a) data leakage;

(b) unauthorised disclosure;

(c) external storage;

(d) unintended retention;

(e) system training usage;

(f) inaccurate interpretation;

(g) misleading conclusions;

(h) hallucinated outputs;

(i) behavioural profiling;

(j) automated decision-making consequences;

(k) cybersecurity incidents;

(l) privacy breaches;

(m) third-party processing activities; or

(n) unknown, unforeseeable or unintended consequences,

arising directly or indirectly from the use of any artificial intelligence system, machine-learning platform, third-party analytics engine or external processing service not directly owned and controlled by Talents Tech Executive Sdn. Bhd. (1203068-V).

You further acknowledge that TalentsTech has no control over the operational logic, storage practices, model training behaviour, retention policies, future usage, interpretive methods or security standards of any external artificial intelligence or third-party platform.
 

5. Orders, Pricing, Payment and Licence

5.1

Orders constitute offers to purchase Products.
 

5.2

A contract forms only upon acceptance or delivery.
 

5.3

Prices may change without notice.
 

5.4

Products are licensed, not sold.
 

5.5

TalentsTech grants a limited, personal, non-exclusive, revocable and non-transferable licence for personal use only.
 

5.6

You must not:

• reproduce;

• commercialise;

• distribute;

• reverse engineer;

• sublicense;

• replicate;

• train AI systems on; or

• create derivative systems from any Product or methodology.
   

5.7 AI and machine-learning restriction.

You must not use any Product, Report, framework or Website content for:

• AI training;

• machine-learning datasets;

• behavioural modelling;

• large-language-model training;

• synthetic dataset generation; or

• automated personality-analysis systems.
   

6. Refunds and Cancellation

6.1

Refund entitlements are governed by Schedule A.
 

6.2

Digital Products become non-refundable once generated or delivered.
 

6.3

Deletion requests after payment immediately forfeit refund eligibility.
 

6.4

Mandatory consumer rights remain preserved where required by law.
 

7. Acceptable Use

You must not:

• violate applicable laws;

• interfere with systems;

• introduce malware;

• scrape data;

• impersonate others;

• misuse biometric systems;

• conduct unauthorised profiling;

• reverse engineer systems; or

• use Products for prohibited high-risk activities.
   

7.1 Prohibited high-risk use.

The Products must not be used for:

• law enforcement;

• criminal justice;

• immigration control;

• military operations;

• insurance underwriting;

• credit scoring;

• surveillance;

• public-sector profiling; or

• automated legal decision-making.
   

7.2 Jurisdiction restriction rights.

TalentsTech may restrict access in jurisdictions where:

• biometric restrictions apply;

• legal exposure is excessive; or

• operational compliance becomes commercially unreasonable.
   

8. User-Generated Content

8.1

Users remain responsible for submitted content.
 

8.2

You grant TalentsTech a worldwide, royalty-free licence to use submitted content for operational and promotional purposes.
 

8.3

TalentsTech may remove content at its discretion.
 

9. Intellectual Property

9.1

All intellectual property rights remain owned by TalentsTech.
 

9.2

This includes:

• frameworks;

• methodologies;

• personality systems;

• scoring structures;

• algorithms;

• reports;

• branding;

• software;

• graphics; and

• training materials.
   

9.3

Unauthorised reproduction or commercial exploitation is prohibited.
 

10. Disclaimers and Technology Limitations

10.1

The Website and Products are provided on an "as is" and "as available" basis.
 

10.2

Biometric technologies and personality frameworks inherently contain:

• interpretive limitations;

• variability;

• probabilistic outcomes; and

• technological constraints.
   

10.3

TalentsTech does not guarantee:

• consistency;

• repeatability;

• universality of results;

• uninterrupted access; or

• system availability.
   

10.4

TalentsTech is not liable for failures caused by:

• cloud providers;

• hosting providers;

• cybersecurity incidents;

• telecommunications failures;

• payment gateways;

• third-party vendors; or

• infrastructure disruption.
   

11. Limitation of Liability

11.1

To the maximum extent permitted by law, TalentsTech excludes liability for:

• indirect losses;

• consequential losses;

• emotional distress;

• reputational harm;

• loss of opportunity;

• business interruption;

• data loss;

• psychological interpretation;

• third-party decisions; and

• reliance on Reports.
   

11.2

Your exclusive remedy is to discontinue use of the Website and Products.
 

11.3

Any claim must be commenced within twelve (12) months from the date the claim first arose.
 

11.4

Class-action and representative proceedings are waived to the maximum extent permitted by law.
 

11.5

TalentsTech's total aggregate liability shall not exceed the amount actually paid by you within the preceding twelve (12) months.
 

12. Indemnity

You agree to indemnify and hold harmless TalentsTech and its directors, employees, contractors, affiliates and partners from claims arising from:

• unlawful conduct;

• infringement of rights; or

13. Suspension and Termination

13.1

TalentsTech may suspend or terminate access at any time for operational, legal, security or compliance reasons.

Upon termination, all licences immediately cease.
 

13.3

TalentsTech may retain archived records where necessary for:

• legal compliance;

• fraud prevention;

• audit purposes;

• cybersecurity investigation;

• dispute resolution; or

• operational continuity.
   

14. Privacy and Data Protection

Your personal information and Biometric Data are governed by the Privacy Policy.
 

15. Changes to the Terms

TalentsTech may amend these Terms at any time. Continued use constitutes acceptance of updated Terms.
 

16. Assignment

TalentsTech may assign or transfer its rights and obligations without your consent.

You may not assign your rights without written approval.
 

17. General

17.1 Entire agreement.

These Terms constitute the complete agreement between you and TalentsTech.
 

17.2 Severability.

If any provision is unenforceable, remaining provisions continue in effect.
 

17.3 No waiver.

Failure to enforce rights does not constitute waiver.
 

18. Governing Law and Dispute Resolution

18.1

These Terms are governed by the laws of Malaysia.
 

18.2

The courts of Malaysia shall have non-exclusive jurisdiction.
 

18.3 Arbitration option.

TalentsTech may elect confidential arbitration in Malaysia at its sole discretion.

Arbitration:

• shall be conducted in English;

• shall remain confidential; and

• shall proceed only on an individual basis.

20. Summary of Consumer Rights
